As an organisation we voted and mandated Dave to proceed with the case of BCA vs CROW. This mandate was delivered both at the Derbyshire AGM and also via the member vote afterwards.

As an unincorporated association, the BCA cannot sue or be sued, however it can serve for a judicial review as in Aireborough Neighbourhood Development Forum v Leeds City Council & Ors [2020] .

Needless to say Dave is mandated as an officer of the BCA to serve this judicial review, as per our votes, the fact that he has done so in his own name does not matter as he is acting in his role on the BCA committee as BCA CROW Liason officer (or words to that effect).

This is a public law matter, as it is the welsh government making the decisions and as such it is the right of the BCA in the public interest of it's members to challenge the decision in the Welsh courts.

I have no idea why this has so much to do with Somerset, cos it hasn't, the case will be brought in the Welsh courts (unless i'm mistaken).
