BCA legal officer - Linda Wilson? Really?

Congratulations! Eight pages on a none topic.  Does it really matter if Linda Wilson is BCA Legal Officer or not.  It will not effect me.  I will still go caving regardless. My only claim to fame is that Linda called me a "fuckwit".  :eek:

I suggest the law will not allow it.  There is a fundamental principle in law that one should not 'gain' from an illegal act.  Although the oft quoted examples apply to those directly involved, I am confident that a court will throw out any claim that an entrance opened by a breach of the CRoW Act should remain open for others to use.  (I presume that in the Twll Du case, the scheduled monument status is considered a more signficiant potential breach.)

Absolutely it matters; it could be disasterous.

She called you a fuckwit? Seems to be a badge of honour.

My comment was more generally about the application of CROW, but using the current issues at Twll Du as an example. I suppose this thread isn't directly about CROW either, so maybe I should do as you ask. Sorry.

I would argue that in _most_ (not all) cases, if you don't have a reasonable expectation of (at least reasonably) open access to cavers after your dig finds caverns measureless to man, you probably shouldn't be digging there in the first place and should find somewhere else.

I actually agree with whoever said 8 pages on something which is not happening, and had it gone to vote within the council where by any position until voted on by an agm would be acting, believe would have been voted against.
I personally don't have anything against linda, obviously differ greatly regards CROW, and would have voted against her as acting legal officer. however it is all academic as the exec are going to field anything legal and then find the right legal person to advice.
anything one has with personal issues has nothing to do with the legal officer position on the council, cause it never happened,

It's not personal issues - until this all kicked off, someone fundamentally opposed to what the BCA members voted for was looking very likely to be voted into a position where they could, as evidenced by Jenny P's post, carry on subverting the members wishes. I'm glad it was declined, but it should never have been a possibility in the first place.
