Leck Fell access - Important update
« on: June 27, 2019, 10:00:32 pm »

The CNCC would like to draw your attention to the following news article on our website:

https://cncc.org.uk/news/20190627-leck-fell-access-important-changes

This is certainly not a decision that has been taken lightly. It represents the outcome of years of focused effort from our Access Officer, Tim Allen, and follows carefully considered discussions amongst all CNCC Officers and the CNCC Committee.

If you have any questions we'll do our best to answer them here.

Does the CNCC take any view on the close season that has (officially at least) applied from April to June ?
(Perhaps a moot point for this year, as it's nearly over).

The CNCC view is that we don't see any justification for the closed season on Leck Fell.  It's been a topic of discussion with both the landowner and National Park Authority in recent years.   As access land it doesn't apply to any other user and removing the condition is something we would seek through negotiations with the landowner.  Of course the matter is complicated on several fronts and whilst the land owner freely admits there is no land management reason for the restriction he also still wants to keep the restriction for personal reasons.  It isn't the reason we are where we are, but it is an indication of why we are there - if you get my meaning.

Doesn't the CRoW Act allow for closed periods when the access is suspended whilst "other activities" (usually shooting) take place? If there have been such closed periods on Leck Fell in the past, presumably if they are required by the landowners in future this closure will also apply to caving access too?

The point is though, its not closed to anyone else, only cavers because well they could.
Anything I say is represents my own opinion and not that of a any club/organisation that I am a member of (unless its good of course)

RestingCaver, yes they can restrict access for up to 28 days each year and they have to give notice to NE beforehand and advertise the closure through signage at access points. The closure would apply to everyone, not just cavers.
